Thus, the most preferred way to run an NGO or a non – profit organization is to form a Public Charitable Trust.
As per the Indian Trust Act 1882, a Trust is an arrangement where the owner (trustor) transfers the property to someone else (trustee) for the benefit of a third person (beneficiary).

Trusts can be classified into two categories:

Public Trust:
It is a trust whose beneficiaries include the public at large. Further, a Public Trust can be further subdivided into Public Charitable Trust and Public Religious Trust.
02.
Private Trust
A private Trust is the one whose beneficiaries include families or individuals. Further, a Private Trust can be subdivided into:
• Private Trusts whose beneficiaries and their requisite shares both can be determined
• The Private Trusts whose both or either the beneficiaries and their requisite shares cannot be determined

What are the documents required for Trust Registration?
If the trust is created, or the institution is established, under an instrument, than in such case, self-certified copy of the instrument creating the trust or establishment of the institution is to be submitted
If the trust is created, or the institution is established, otherwise than under an instrument, than in such case, self-certified copy of the documents evidencing the creation of the trust or establishment of the institution is to be submitted
Self-certified copy of registration with the Registrar of Companies or Registrar of Firms and Societies or Registrar of Public Trusts, as the case may be
Self-certified copy of the documents evidencing adoption or modification of the objects, if any
Where the trust or institution has been in existence during any year or years prior to the financial year in which the application for registration is made, than in such case self-certified copies of the annual accounts of the trust or institution relating to such prior year or years is to be submitted
A note on the activities of the trust or institution needs to be submitted
Self-certified copy of existing order granting registration under section 12A or section 12AA and
Self-certified copy of order of rejection of application for grant of registration under section 12A or section 12AA, if any.
Process
Step 1: Choose an Appropriate Name for the Trust & Decide the Settlers or Authors and Trustees of the Trust
Step 2: Formulate Memorandum of Association (MOA) and Trust Deed of your Trust
Step 3: Prepare Trust Deed on a Stamp Paper & Prepare Trust Deed on a Stamp Paper
Step 4:Submit the Trust Deed with The Registrar & Obtain the Registration Certificate

The Trustees do not have the right to sell the property, however, the trust properties can be sold after obtaining prior permission from the appropriate civil court.
Based on the cause and objectives, NGOs can be registered online as Trust or Section 8 companies.
The trust is usually irrevocable in nature. For reasons like disqualification of trustees, absence of trustees, mismanagement of the trust, the trust can be merged with a trust having similar objective with the permission of the court.
There is no specific certificate for a trust registration. On the other hand, getting the trust deed registered with the appropriate authorities would suffice.
